Gyeonggi panel urges job foundation to end automatic C for contract-end workers

🇰🇷 Южная Корея, Suwon 07:54 Регулирование Бизнес2 Официальные обновлено 17 ч назад первым сообщил 한국일보

Версия 2: A third outlet, Hankook Ilbo, added the specific complaint by a worker who served 11 months and received a C grade, the foundation’s own explanation of why it excludes retirees from relative evaluation, and the detail that permanent staff who leave are covered by the same standard; the earlier facts about the recommendation, the handbook and the legal concern are unchanged.

Коротко

The Gyeonggi Province Citizens’ Rights Commission recommended that the Gyeonggi Job Foundation change its performance evaluation rules, which exclude fixed-term workers who leave when their contracts end and give them the lowest grade, C, without assessing their actual work. The commission said the practice may conflict with the ban on discriminatory treatment of fixed-term workers, and it said it will check whether other Gyeonggi provincial institutions use similar handbooks. The foundation says it separates retirees to avoid distorting the relative evaluation of serving staff.

The Gyeonggi Province Citizens’ Rights Commission said it recommended that the Gyeonggi Job Foundation improve the way it evaluates fixed-term workers whose contracts have ended, after finding that they were given the lowest grade without a separate performance assessment. Yonhap reported that the commission announced the recommendation on Oct. 6. According to the commission, the foundation’s performance evaluation handbook excludes workers who retired during the performance year from evaluation and assigns them a final C grade. [ 1 , 2 , 3 ]

Yonhap reported that grades run from S to C, distributed at 20 percent S, 40 percent A, 30 percent B and 10 percent C, and that the foundation pays performance pay on a differentiated basis according to the result. It gave the example of a fixed-term worker who served 11 months of a 12-month evaluation period but, because the contract ended and the worker left, could receive a C without being evaluated. Workers on parental leave or newly hired workers who worked less of the evaluation period can be assessed under separate standards, and could therefore receive a higher grade and more performance pay than a contract-expired fixed-term worker, the outlets reported. Yonhap said this could produce what the commission called a “treatment reversal,” with a worker who served longer and performed better ending up worse off. [ 1 , 2 ]

Asia Economy reported that the commission considered it reasonable in principle to exclude retirees from the relative evaluation applied to serving staff, but judged that assigning a uniform C solely because a contract ended, without assessing the actual service period or work results, needs improvement in terms of fairness and proportionality. The commission said the practice may conflict with the prohibition of discriminatory treatment under the Act on the Protection of Fixed-term and Part-time Workers, and Asia Economy added that it said the question should also be weighed with whether there are reasonable grounds for the evaluation gap. [ 1 , 2 , 3 ]

Hankook Ilbo reported additional detail: a worker identified as A, who served 11 months as a fixed-term employee at the foundation from 2024 to 2025, received a C grade after leaving and recently filed a complaint arguing the evaluation method was unfair. The outlet said evaluation results affect performance pay paid the following year, and that the foundation’s handbook also applies the same C-grade standard to permanent staff who leave, while the Gyeonggi provincial government conducts a performance evaluation for staff who retire after working two months or more. [ 3 ]

The foundation told Hankook Ilbo that including retirees in the same relative evaluation as serving staff could distort results, for example by distributing low grades to retirees and high grades to those still working, and that the measure was intended to prevent this and create a fair relative-evaluation environment among serving staff. The outlet reported that the foundation has no separate criteria for evaluating retirees. [ 3 ]

A commission official was quoted by Yonhap as saying the recommendation was made so that a performance evaluation system consistent with the principles of fairness and proportionality would be prepared for workers who leave when their contracts expire, and that the commission would examine whether other Gyeonggi provincial institutions have similar performance evaluation handbooks. Asia Economy quoted commission chair Jang Jin-su as saying the body would continue to work so that grievances raised by residents are closely reviewed and turned into institutional improvements that raise fairness and rationality. [ 1 , 2 ]

Почему это важно

The recommendation concerns how a provincial public institution rates and pays fixed-term staff, a category covered by the law against discriminatory treatment, and how one worker’s complaint over a uniform C grade is handled. The commission said it will look at whether other Gyeonggi provincial institutions have similar evaluation handbooks, so any change could reach beyond the job foundation.

Пока неясно

  • Whether the Gyeonggi Job Foundation accepts the recommendation or will change its handbook. Hankook Ilbo reports the foundation’s explanation for its practice but no commitment to revise it, and the other documents do not report a response.
  • Whether the automatic C grade constitutes unlawful discriminatory treatment. The commission said the practice “may” run counter to the law and that it should be weighed together with whether there are reasonable grounds for the evaluation gap; no definitive legal finding is reported.
  • The full details of the worker’s complaint and any outcome. The complaint by a worker who served 11 months is reported only by Hankook Ilbo, a single source, and no resolution is described.
  • Whether the same C-grade rule applies to permanent staff who leave, and how widely it is used. Hankook Ilbo says permanent retirees are covered by the same standard, but the other documents describe only fixed-term workers, and no document says how many workers were affected.

Что пишут местные СМИ

Деловые СМИThe two business outlets reported the recommendation and its reasoning in detail. Asia Economy set out the commission’s view that excluding retirees from relative evaluation has some rationality but that a uniform C without assessing service period or performance needs improvement for fairness and proportionality. Hankook Ilbo added the case of a worker who served 11 months and then filed a complaint, the foundation’s explanation that including retirees could distort relative evaluation, and noted that Gyeonggi provincial government evaluates staff who worked two months or more before retiring. [ 1 , 3 ]
Официальные источникиThe official outlet, Yonhap, reported the recommendation with the grading structure — S, A, B and C at 20, 40, 30 and 10 percent with differentiated performance pay — and an example of a worker who served 11 of 12 months but could still receive a C. It highlighted the possibility of a “treatment reversal” in which workers with longer service and better results end up worse off, and quoted a commission official saying it would examine whether other Gyeonggi provincial institutions have similar handbooks.
