Daegu District Court Criminal Division 13 sentenced a 62-year-old man surnamed Baek to seven years in prison on October 6, in a citizen participation trial on charges of murder and attempted murder of a lineal ascendant, Yonhap reported. The court was presided over by Judge Chae Hee-in. [ 2 ]

According to Yonhap, the charges stem from an incident on March 22 at Najin Port in Gampo-eup, Gyeongju, North Gyeongsang Province. Baek was accused of giving sleeping pills to his mother, who has dementia, and to his niece, who has a severe intellectual disability, then taking them to the sea, killing the niece and trying to drown his mother before witnesses stopped him. Yonhap reported that Baek had cared for his mother with dementia, his younger sister who had an intellectual disability, and her daughter from around 2018, and that after his younger sister died in 2022 he was effectively alone in handling the household and daily care for his mother and niece. About a month before the crime, he had told his younger brother he was at his limit and that the niece hit him severely, according to the report. [ 2 ]

At trial, Yonhap reported, all seven jurors unanimously found him guilty, and on sentencing four jurors favored seven years and three favored eight years. The court said murder can never be justified and cited the extreme fear the deceased niece likely felt and the sense of betrayal his mother would have experienced, adding that the risk of reoffending against his mother was not light. Prosecutors had sought 12 years, calling the victims vulnerable and the crime planned rather than impulsive, while the defense cited eight years of sole caregiving, stress and depression and asked the court to consider how the case differed from an ordinary killing. In his final statement Baek said he had committed a crime deserving death and asked for a heavy sentence, adding that if released he would care for his mother. His younger brother, who testified as a sentencing witness, said he did not want his brother punished. Yonhap reported Baek had no prior criminal record. [ 2 ]
